    Question Statute Barred

    I have debt that was created Sept 2004 - over 6 years ago, however on my Credit report it states dates of default between february and May 2005 so under 6years. What is the letter of the law regarding Statute Barred?

    A debt is considered "Statute Barred" if a creditor has not contacted a debtor for a period of 6 years and no action has been taken on the account.

    Although the debt is still legally acknowledged as being owed, the creditor is not able to take any legal action against the debtor in order to recover the debt. It is a complete defence to court proceedings for the debtor.

    It would seem that your default is under six years and therefore you are not covered by Statute Barred.

    Any information will fall off your credit file after six years.
