I have an appeal coming up in a few weeks but the main witness has fled the country before giving a PACE interview. This is for an infringement of copyright for goods sold on line. I was an innocent party but following my conviction and sentence a case is being brought against the three individuals who were responsible, one of these is the witness I wanted to call who has left the country. It was also directed by the Crown Court that I should receive the statements of two of these parties by 14 August but I have now been told by the prosecution I will not receive the one they were able to obtain until first or second week in September which doesn't give me any time to prepare my defence but this is irrelevant as the party I was going to call as a main witness hasn't given a statement. I do not have a solicitor or barrister. I do not feel I cannot get a fair hearing until I can call this absent witness or at least until after the case against these three parties is heard. Can anyone please advise me?
