    Electronic tagging

Hi, I have been given an 8 week prison term suspended for a year and a 12 week curfew with an electronic tag at home for benefit fraud. Please could you tell me if I will have a criminal record, how long it lasts, can I still go to Egypt as a tourist. Also it has been 8 days since my curfew started but have not had the tag fitted yet?I do not want to ask for it as wearing the tag will obviously be humiliating for me being a mother with young children so everyday not having it is a blessing but obviously I am in every evening as the times are 20.00-07.00

    Hi discoverytd5i,

Thanks for posting. How long do you plan to go to Egypt for and to which part? UK nationals going to Sharm El Sheikh, Dahab, Nuweiba and Taba resorts ONLY, for a maximum of 14 DAYS, do not require a visa prior to travelling as a free entry permission stamp will be granted upon arrival. This means it's quite possible that the criminal record will not matter.

If you plan to travel elsewhere or for a longer period, you will have to apply for a visa and will have to mention your criminal record, which could result in your application being rejected.

Has your tag been fitted yet? We cannot really condone not telling anyone. Although it is good that you have been sticking with your curfew hours as if you are caught not at home, you will be made to serve your 8-week sentence.

    Best of luck,

Hi, Thankyou for your reply, I have not had my tag fitted yet and it's now 3 weeks? I spoke to a. Solicitor as I was concerned but they said I didn't need to contact the court as they handed down the sentence to me and it wasn't my responsibility to chase the tag company up, I am however sticking to the curfew hours. I am in sharma el sheik for 2 weeks but we will not be going to Cairo, how long will the criminal record last? Thankyou for your help x

Hi, after a certain amount of time (of non-offending) a criminal conviction can become 'spent' meaning they are disregarded for legal purposes.

For a suspended sentence of less than six months, the rehabilitation period is seven years. So after this time, you do not have to reveal the conviction or admit its existence in most circumstances, including, for example, when applying for a job.
