    Contructive dismissal ( seriously breaching the duty of mutual trust and confidence )

    Hi,
    How long must you have worked for an employer to allow you to claim under the above title, I believe it to be ( No min limit ) is this true ? ie 1 Week will do.

    Hi vek53don,

    For most forms of unfair dismissal, you have to have been employed for more than 12 months. This is only waived if the dismissal was an automatic unfair one (reasons for these are listed on the Directgov site).

    Remember that to bring a claim, you must do so within three months of resigning.
