    selection criteria

    Please help..

    Can a national employer select employees for redundancy solely on geographical location when other employees performing the same duties but with shorter length of service have not even been put of notice of possible potential redundancy.?

    Also can an employer choose 1 employee to remain in position while making other employees redundant without comparing ALL in a matrix?

    Any advice would be great, thanking you all in anticipation

    How an employer manages their selction criteria, whatever they are based on, is their business. The law only says that it must be fair and objective - it does not lay out what that means. It may be fair to consider only one area at any time, if the "area" is treated as a separate estblishment. The fact that others in different locations may have the same job isn't the test - it is this test of "separate establishments", which isn't an easy test to apply and would require legal advice to challenge.

    In terms of not comparing all within the matrix, this is clearly not fair and further legal advice should be sought from a solicitor, to ascertain you position.
