    Assault on a child

    My 9 year old son was assaulted by my next door neighbour who is 65 year old. The neighbour was arrested, cautioned then released. I'm not happy with the way it was dealt with by the police and want an injunction to stop the neighbour approaching my child. How do I proceed?

    You can obtain an injunction (called a non molestation order/ injunction) by applying to The County Court, Fill in Form Number N 016A. If you go into your local County Court The "front desk" staff are usually very helpful (although they can't give legal advice) they will tell which forms to use and give you some literature to help you. Perhaps you could claim damages from your neighbour too, ask in court for a form.( usually N1.) Good luck.

    hang on hang on, sounds like your child was misbehaving and got a deserved clip round the ear. What was a child doing to be assaulted?

    Objection , Your Honour. A child has a right not to be assaulted by the old man next door regardless of behavior. The child's mother has a right to protect her child by Court Order.

    Because he is 65 years old and he will be a gentle person but there should be a mistake by your child somewhere this is the only reason they treat him like that.
