I am writing to you on behalf of a good friend who is currently in a difficult position and I do not believe he is receiving best advice from his solicitor.
My friend and his partner had children, house and a removal business when his partner decided to leave him and their children when the youngest was 18ths old. He had to give up his fledgling business as it didn’t provide him with enough income to provide a full time nanny for the children. So he found himself having to become a full time father, his mortgage was put on interest only and for the next several years he managed to hold his family together until his youngest was old enough to go to school and he returned to work. Unfortunately with little qualifications and the need to be home afternoons and evenings he has only managed to find delivery driving work so he has had to keep the mortgage interest only and the family have never managed to have a family holiday.
Now that the youngest child is now almost 15 my friend has received a letter from a solicitor of his ex partner demanding half of the value of the property. My friend has had no financial support from this woman from the day she walked out and the children have never seen her as she has never attempted to contact them at all not even birthdays or Christmas.
My friend has now had to sell his car to pay his solicitor but as far as I can see he has had little to show for it. Unfortunately as he has little money he never had her removed from the mortgage. I believe that if he discharges his solicitor and writes to her solicitor informing them that he believes that she has no claim to any part of the property or any other property that he or his children possess (as he doesn’t have a pension either). Then I believe that they will either give up or have to take him to court where he can plead his case. I would find it incredulous that any judge could find any other judgement but in favour of my friend.
