    Is he right ?

    The situation that i find myself in is this - i have been living with my partner for 11 years we have a joint mortgage. I was living in the house before with my 2 children.

    We are now splitting up, we have 2 children together 10 and 8. My boys are now 21 and 19, the latter away at uni. He is wanting to sell the house as he says i do not need such a large one and that we only have 2 dependants there.

    Can he make me do this ?

    Any help on this matter would be appreciated

    Not a simple yes
    In case if divorce the court starts from the presumption of 50 : 50 split
    But if kids are living in the house in question the that can change the game.
    Take legal advise at CAB

    If you guys are divorcing then the share must be 50:50 between both of you,
