I separated in 1999 and finally got divorced in 2002. In the divorce settlement i was given entitlement to 40% of his fully commuted Naval pension on his leaving the navy in 2013, which at the time was fine. I was made homeless due to the fact that i was married to a Serving Naval Officer and i subsequently was evicted from my married quarter and placed into Housing Association. The place i was given was like a demilitarized zone so i planned to save up and buy a house and asked my ex husband for financial help toward this. He agreed to give me £18500, In sheer desperation to get out of the flat we were in, i signed a document from my ex husbands solicitor which released him from any financial commitment to me although my children continued to receive maintenance...

The house i bought i don't own outright. the housing association gave me 25% of the asking price as my deposit in order for them to have their flat back. and the £18500 he gave me went on central heating, double glazing new carpets, redecoration etc I make no repayments to the housing association until such time that i decide to move and i have to repay them 25% of present day value. Current value of my house has increased by £15,000 which means i have no equity in my house. My financial circumstances have changed drastically and i now struggle to survive. I dont qualify for any benefits.

My question is......do i have a chance of having my divorce settlement overturn and get the original 40% minus the £18500 he has already given me!
