Dear all,
I am a failed asylum seeker with my partner from a different non EU country. We both came to the UK in 2007 from different non EU countries. We have two children aged 4 years and 2 years both were born in the UK and the older one has been diagnosed autistic recently. His autism matter was discussed before the judge in first tribunal but at that time my son was not officially diagnosed autistic. I have exhausted all my appeals and the last one to be applied to the court of appeal was not appealed by me as my new lawyer said it would be total waste of money rather I should submit a fresh claim.
I am so much depressed as I cannot take my partner to my country and even cannot go to her country. My autistic son will not be able to get the same level of treatment as he is getting here in the UK. He has also started going to Nursery meant for children who need special education. My new lawyer is not famous enough and I really do not know about his capabilities in dealing with immigration matters and I chose him because he accepted my free legal entitlement. The fresh claim has not yet been drafted. I ask you only one question through this forum that can UKBA deport us to two different countries and if so who the children will accompany to and is there anyway to appeal against this?
Every little helps and I would like comments from some experienced lawyer or the people who went through similar situation.
