Just need some advice. An item was bought through private sale. A price was reached and paid for later shipment. Before the seller shipped the item, he found another buyer. He sold the item to the second buyer and gave the money back to the first buyer.

Even know the first buyer received his money back. The first buyer who paid first really wanted the item. What type of rights does the buyer have under UK law?

In these circumstances the contract is only made when the seller despatches the goods to the buyer.
As the buyer received a full refund there is no actionable loss.
