You wouldn't be liable for any solicitor's fees in the small claims court. As far as I'm aware, the only charge you would have to pay is the admin fee to the court.

Hi. My previous mortgage provider charged me £295, a "redemption administration charge" for switching after the 2 year term finished. I have written to them with no success so far in trying to reclaim at least most of this fee on the basis that it is an excessive charge to cover the administration involved and therefore an unfair term (they are unjustly enriched). Does anyone know of any similar cases that have been to the small claims court, and what exactly would the level of financial risk be in bringing my claim? Would I be liable for their solicitors fees?
